Invitation to tender for projects on Regulatory Framework for CCS (and possibly CCU) in the Nordic countries.

The Nordic working group for the environment and economy (NME) under the auspices of the Nordic Council of Ministers welcomes tenders for the project Regulatory Framework for CCS (and possibly CCU) in the Nordic countries. Tenders must be submitted by 9 June 2022.

In 2021, NME commissioned a study on regulatory instruments for BECCS from a Nordic perspective. The study dealt with different types of obstacles to developing BECCS projects in the Nordic countries (http://urn.kb.se/resolve?urn=urn:nbn:se:norden:org:diva-12207 ). The focus of the report is on the economic and technical issues related to BECCS, but it also briefly mentions the legal aspects of the problem. NME’s programme of work for 2022 includes a follow-up to the BECCS project, the intention of which is to scrutinise the legal aspects of the CCS topic.

Assignment and purpose of the project

The project must include the following:

  • A review of the national and international legislation that regulates the use of CCS in the Nordic countries. The focus of the analysis must be on the significance of the regulatory framework, particularly in relation to cross-border CCS activities.
  • A review of differences and similarities in the current regulations regarding CCS in the Nordic countries at present, the relevant EU legislation in the area, with regard to how it has been implemented within national legislation.
  • A review of the current state of affairs for the London Convention on anti-dumping. An assessment must be made to determine how the Convention has been developed with the CCS in mind and the extent to which cross-border CCS activities are affected by the London Convention.
  • In 2022, the EU ETS Directive will be revised. To what extent does the directive cover CCS activities of various kinds and what are the incentives or barriers provided by the directive? Will the entire CCS chain from capture to storage be covered? The analysis of the revision of the directive must be explicitly made from the perspective of the Nordic countries.
  • The regulations for the CCS activities presuppose the follow-up, reporting, and verification of CO2 emissions. To what extent can this area be pertinent for Nordic co-operation?
  • An assessment of which government functions presuppose cross-border CCS activities in practice. Is there a need to develop Nordic co-operation on CCS at the institutional level?
  • The study will take a position on whether there is a need to develop models for how CCS co-operation between the Nordic countries could be developed, not least with regard to co-operation at project level, legal frameworks, division of responsibilities between private and state stakeholders and questions about how emissions are noted in cases of leakage, for example.
  • The study can also present recommendations on how increased interaction between the Nordic countries in the field of CCS could be promoted.


The budget framework for the project is DKK 400,000 (incl. VAT). The budget should cover standard project expenses as well as travel and communications.


NME at the Nordic Council of Ministers must receive tenders no later than 9 June 2022, at 15:00 CET. All documents must be submitted by this deadline. Material received after this date will not be taken into consideration. A decision will be made in June, and all applicants will be informed of it. The date for the final report will be set in the project contract.


Applications must be e-mailed to NME’s administrative body (registratur.sodraosterbotten@ntm-centralen.fi). The project description/application form and compulsory budget form must all be in one of the Nordic languages. Applications must cite the journal number EPOELY/795/2022

In assessing the tenderers, emphasis will be placed on:

  • the structure and planning of the work, including methodology and how relevant data will be collected and processed;
  • the timetable;
  • the distribution of responsibilities, use of time, general skills, and qualifications of those managing and implementing the project;
  • the tenderer’s previous experience in the area;
  • the Nordic contacts and networks that will be used in the project and fluency in the Nordic languages;
  • the expenditure for the proposed project period, including hourly rates and other expenses; and
  • the planned dissemination of the project.
